These Terms of Service apply when you visit BYD SPOT, use store features or purchase products. By using the site or submitting an order, you agree to these Terms and to the policies linked from the store. If you do not agree, do not use the service.

Store eligibility and acceptable use

You must have legal capacity to enter a purchase contract in your jurisdiction. You may not use the store for unlawful, fraudulent, abusive or harmful activity; interfere with security or operation; introduce malicious code; scrape or copy the service in a way that violates law or rights; or use false contact, payment or delivery information.

Independent retailer and trademarks

BYD SPOT is an independent accessories retailer and is not affiliated with, endorsed by, or sponsored by BYD Company Limited. Vehicle names and trademarks are used solely to identify product compatibility. BYD and other vehicle names, marks and images remain the property of their respective owners. Their appearance on the site does not indicate an official commercial relationship.

Product information and fitment

We aim to present clear titles, images, descriptions, prices, variants and compatibility details. Photography, screens and lighting can affect color. Packaging and minor non-functional details may change. Dimensions and specifications should be checked when they affect use.

Vehicle names, model years and specifications can vary by market. Customers are responsible for reviewing the product Compatibility section and selecting the correct documented model, year, powertrain, LHD/RHD layout, size, connector and variant. BYD SPOT will not intentionally represent an uncertain configuration as confirmed fitment. Nothing in this clause limits rights that cannot be excluded under applicable law.

Prices and corrections

Store prices are currently displayed and charged in USD unless checkout clearly states otherwise. Taxes, duties, brokerage or import charges may apply. We may correct typographical, pricing, specification or availability errors before accepting or fulfilling an order. We will contact the customer when a material correction affects an order; the customer may cancel and receive a refund when required.

Orders and payment

Submitting checkout is an offer to purchase. An automated confirmation acknowledges receipt but does not guarantee acceptance. We may refuse or cancel an order because of payment failure, suspected fraud, prohibited destination, inventory error, pricing error, fitment issue or inability to fulfill. If payment has been captured for a cancelled order, it will be refunded to the original method.

Shipping, title and risk

Shipping destinations, rates, processing, tracking, customs and address requirements are described in the Shipping Policy. Delivery estimates are not guarantees unless the carrier explicitly provides one. Ownership and risk transfer according to applicable law and the agreed delivery terms; mandatory consumer rights are not excluded.

Returns and refunds

Return eligibility, the 30-day request period, product-condition rules, fitment-related returns, damaged-item claims and refunds are described in Returns & Refunds. Contact us before returning a product. Statutory rights for defective or incorrectly supplied goods continue to apply.

Intellectual property

Except for third-party marks and content, the site structure, original text, graphics and branding are owned by or licensed to BYD SPOT and protected by applicable law. These Terms permit personal shopping use only and do not transfer ownership. Product and vehicle images may be owned by their respective licensors or sources.

Third-party services and links

Shopify, payment providers, carriers and other service providers operate parts of the shopping experience. Third-party services and external links may have separate terms. BYD SPOT is not responsible for content or conduct outside its reasonable control, but this does not limit responsibility that applicable law does not allow us to exclude.

Disclaimers and liability

To the maximum extent permitted by law, the service is provided on an “as available” basis. We do not guarantee uninterrupted access or that every accessory will meet preferences not stated in the listing. We are not liable for indirect or consequential loss where exclusion is lawful. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded, including responsibility for fraud, willful misconduct, personal injury where applicable, or mandatory product remedies.

Indemnity

Where permitted by law, you agree to reimburse reasonable losses arising from your unlawful use of the service, violation of these Terms or infringement of another person’s rights. This section does not apply where prohibited by consumer law.

Severability, changes and governing rules

If part of these Terms is unenforceable, the remaining provisions continue to apply. We may update the Terms for operational, legal or security reasons; the version in effect when an order is placed applies to that order unless law requires otherwise. These Terms are governed by the laws applicable to the store operator, together with mandatory consumer protections and dispute rights in the customer’s jurisdiction.
